8. Annual declaration to the General Register of Best Available Techniques (BATs) for all livestock farmers is made mandatory. Currently, it is only mandatory if the data in Annex I is amended.
The annexes to the regulation are amended to: include data corresponding to bovine animals, improve the quality of the information and the understanding of some concepts and to correct some definitions. The list of fuel types used on farms in Annex I is extended in order to align it with the applicable EU legislation.
A reference to Law 30/2022 is included within the regulations applicable to infringements and penalties.
9. Royal Decree 988/2022, of 29 November, regulates the General Register of Best Available Techniques (BATs), establishing, among other things, the data necessary for its completion. Currently, its annexes establish the basic data to be reported by farms for swine and poultry species, which were the only species subject to this obligation at the time. With the publication and entry into force of Royal Decree 1053/2022, of 27 December, this obligation also extends to certain types of bovine farms. It is therefore necessary to amend the annexes in order to include the information relating to this species. We also wish to take this opportunity to make other amendments to the annexes in order to improve the quality of the information and the understanding of certain concepts, and to correct some definitions. Furthermore, the current regulation establishes that all farm owners only have to report, on an annual basis, the mandatory data in Annex I that have changed since the previous report. The inclusion of new fields and the amendment of some existing fields in the Register make it mandatory for all livestock farmers to submit the declaration on an annual basis. Finally, reference is included to the infringements and penalties established in Law 30/2022, which was approved after the entry into force of Royal Decree 988/2022.
