5. Order amending the Order of 23 November 2022 laying down the specifications for producer responsibility organisations and individual systems in the extended producer responsibility scheme for textiles, footwear and household linen (TLC)
6. Clothing textiles
7.
8. This Order amends the specifications for the EPR scheme for clothing textiles, footwear and household linen to introduce an adjustment to the financial contribution paid by producers for textile products placed on the market. The financial contribution will then be adjusted to reflect a penalty linked to the sustainability of industrial and commercial practices, in accordance with Article 5 of Law No 2026-602 of 8 July 2026, which aims to reduce the environmental impact of the textile industry.
This Order is accompanied by a methodological note, which will be published on the Ministry’s website, explaining to producers how this penalty is calculated.
9. This penalty targets ultra-fast fashion, as it generates excessive amounts of waste due to the overconsumption of textile products. Its purpose is to finance the exponentially increasing cost of managing textile waste generated by these industrial and commercial practices. Member States may require organisations responsible for EPR, which in France are producer responsibility organisations, to introduce such a modulation, pursuant to Article 22c of Directive (EU) 2025/1892 of 10 September 2025.
9a. The EPR provides financial support to sorting operators, in addition to the revenue they receive from the re-use of used textiles. However, there has been an increase in the volume of textiles placed on the market in France (a 26 % rise between 2021 and 2024, according to ADEME figures), which automatically leads to an increase in the amount of textile waste discarded. The measure therefore intends to finance this additional cost, making it possible to cover the costs of the collection and management of waste, as provided for in Article 22a(8) of Directive 2008/98/EC.
9b. The criteria selected, namely the breadth of the product range and the incentives to repair, expressly repeat those in recital 40 of Directive (EU) 2025/1892, and more specifically ‘the breadth of the range of products, which is understood as the number of product references offered for sale by a producer, with thresholds defined by market segment’ and ‘incentives to repair, which are understood as the probability that the product will be repaired on the basis of the repair cost/reference sales price ratio, or the provision of a repair service by the producer. ’
It has not been envisaged to retain any criteria other than those proposed by Directive (EU) 2025/1892.
9c. The threshold adopted applies only to products marketed by companies implementing industrial and commercial strategies relating to ultra-fast fashion.
