5. DECREE of............ 2022, amending Decree No 23/2008 on technical requirements for fire protection of buildings, as amended by Decree No 268/2011.

8. The proposed legislation concerns the area of fire protection of buildings in which pre-school care is provided, including childcare in a children’s group. It lays down requirements that must be met by a building or part thereof intended for the activities of a school, a school facility or for pre-school care. It now also regulates fire protection requirements for the use of premises in which a childcare service is provided in a children’s group.
The amendment to the Decree contains references to the following national and European regulations and technical standards:
- Directive (EU) 2015/1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical regulations and of rules on Information Society services
- Act No 133/1985 on fire protection, as amended by Act No 186/2006;
- Act No 561/2004on preschool, primary, secondary, higher vocational and other education (the Education Act), as amended;
- Act No. 247/2014 on the provision of childcare services in a children’s group and amending related acts, as amended;
- Act No 455/1991 on trade licensing, as amended;
- ČSN 73 0802 ed.2 Fire safety of buildings-Non-production structures, catalogue number 510825
- ČSN 13501-1 Fire classification of construction products and structures - Part 1: Classification according to the results of reaction to fire tests, catalogue number 508247.
Neither Decree No 23/2008 on technical requirements for fire protection of buildings, as amended by Decree No 268/2011, nor the draft legislation contain references to technical documents, company standards, European standards, harmonised standards, international standards containing a national annex or a national note, or an international recommendation. Decree No 23/2008 on technical requirements for fire protection of buildings, as amended by Decree No 268/2011, contains no references to
national technical standards.

In connection with the adoption of Act No 329/2021 amending Act No 247/2014 on the provision of childcare services in a children’s group and amending related acts, as amended, and some other acts, a need arose to revise the sub-statutory rules of a technical nature affecting the fire safety of premises in which a children’s group is located.
It is therefore necessary to build on the existing fire safety system of buildings with new legislation that will take into account the new specificities of the use of the buildings or their parts for the operation of children’s groups. It is therefore necessary to amend the Decree on technical requirements for fire protection of such buildings. The proposed Draft provides sufficient fire protection for buildings, corresponding to new legislation related to the provision of childcare in a children’s group.
The present draft is fully compatible with European Union legislation, European Union case law, and the general principles of European Union law; the basic requirements for buildings in relation to fire safety are based on Regulation (EU) No 305/2011 of the European Parliament and the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC.
