Preliminary draft ordinance amending the Ordinance of 1 March 2007 on the protection of the environment against any adverse and harmful effects caused by non-ionising radiation, the Ordinance of 5 June 1997 relating to environmental permits and the Ordinance of 2 May 2013 on the Brussels Code on Air, Climate and Energy Management.

7. - Directive (EU) 2018/1972 of the European Parliament and of the Council of 11 December 2018 establishing the European Electronic Communications Code:

Article 58: The procedures laid down in Directive (EU) 2015/1535 shall apply with respect to any draft measure by a Member State that would impose on the deployment of small-area wireless access points different requirements with respect to electromagnetic fields than those provided for in Recommendation 1999/519/EC.

8. The preliminary draft modifies the existing Ordinance. It sets the immission threshold for antennas (GSM, public Wi-Fi, etc.) at 6 V/m. This threshold applies to all zones accessible to the public.

The purpose of this preliminary draft is to:

- incorporate in the scope of the Ordinance the waves emitted by the broadcast (=radio transmitters);
- increase the immission threshold to 9.19 V/m indoors and 14.57 V/m outdoors
- incorporate provisions on energy consumption and waste management in the sector

Since public Wi-Fi antennas are not excluded from the scope of the Ordinance, Article 58 of Directive 2018/1972 of 11 December 2018 applies.

Environment - Health - Non-iodising radiation

9. The purpose of the preliminary draft ordinance is primarily to amend the aforementioned Ordinance of 1 March 2007 to take into account technological developments, while continuing to ensure a high level of environmental protection.

The preliminary draft ordinance has a threefold objective:

- to incorporate the waves emitted by broadcasting into the legislation in order to better protect the public from any harmful effects of non-iodising radiation;

- to increase the eligible thresholds in areas accessible to the public in order to allow the development of mobile telephone networks, in particular with the arrival of 5G;

- to incorporate provisions on energy consumption and waste management in the sector with a view to reducing the associated environmental impacts.
