5. Draft Law on the introduction of a reparability and durability score and the dissemination of information on the duration of products’ software compatibility.
6. The purpose of this draft Law is to promote the repair of products and extend their lifetimes in order to limit their impact on the environment.
The products concerned are electrical and electronic equipment, determined and defined by two draft Royal Decrees implementing this Law (the draft Draft Royal Decree determining the products covered by the reparability score, the technical standards for establishing the scores for each criterion and the method of calculating the overall score and the draft Royal Decree determining the products covered by the obligation to provide information on the duration of software compatibility).

The draft Law on the introduction of a reparability and durability score and the dissemination of information on the duration of products’ software compatibility (hereinafter: the draft Law) is part of the Federal Action Plan for a Circular Economy, adopted by the Council of Ministers on 17 December 2021.
Firstly, the draft Law aims to highlight the reparability, durability and compatibility characteristics of products. Secondly, the draft Law stipulates that the placing on the market of the products concerned is conditional on obtaining a minimum score.
The draft Law introduces a reparability score established on the basis of several criteria (the availability of technical information and maintenance manuals, the ease with which the product can be dismantled, the availability of spare parts and their delivery time, the price of spare parts and other criteria specifically related to the product). The entry into force is scheduled for March 2023.
The King can, via a Royal Decree, supplement the reparability score with a durability score by adding the criteria of robustness and reliability. The draft Law also introduces an obligation for the party responsible for placing the products concerned on the market to provide information on products’ software compatibility. In other words, it must provide information on the length of time the manufacturer or supplier will support and update the operating system or software to ensure normal use of the product. Manufacturers and importers are responsible for providing the compatibility information and the score. Distributors and sellers of products are responsible for their display.
This draft Law is accompanied by three draft Royal Decrees (also notified to the European Commission). The purpose of the first is to determine which products are covered by the reparability score and the software compatibility obligation. The second determines the technical standards by product category to establish the scores and the method of calculating the overall score. The third sets out the communication methods, format and accessibility of the scores and the compatibility information.
9. This legislative initiative is part of the Federal Action Plan for a Circular Economy, adopted by the Council of Ministers on 17 December 2021.
This legislative initiative therefore contributes to the protection of the environment by first highlighting the reparability and durability characteristics of products. In this way, the end user will be able to more easily become aware of the repairable and durable nature of the product they wish to acquire. Secondly, it establishes provisions to make the placing on the market of the products concerned conditional on obtaining a minimum score. This draft Law therefore constitutes a tool to combat premature obsolescence in order to avoid early disposal of products and to preserve the natural resources necessary for their production.
