5. Draft Second Act amending the Hamburg Climate Protection Act

8. The Draft Act provides for the amendment of obligations, but also the introduction of new obligations for private owners of private and public buildings. In addition, obligations for heat grid operators are amended. In particular, the reader’s attention is drawn to:
point 14 – amendment to § 11 of the HmbKliSchG (restrictions on the new connection and replacement of electric heating systems); point 16 – amendment to § 13 of the HmbKliSchG (priority of structural summer thermal protection in existing buildings);
point 25 – amendment to § 22 of the HmbKliSchG (climate-friendly building materials for public buildings). In all other respects, the reader is referred to the attached Draft Act.

9. The draft aims to bring the legal climate protection targets of the Free and Hanseatic City of Hamburg in line with current developments, specifying the path for reducing CO2

emissions in greater detail with a view to ultimately achieving net carbon neutrality for the year

2045. In addition, the content of the instruments already laid down in the Act is being further developed (see examples in point 8, above). Furthermore, enforcement of the Act is also to be strengthened by introducing further powers for the competent authorities and the introduction of administrative offences.
