So as to optimally cover the area of intoxicants and addictive substances, which has been evolving rapidly in recent years, nicotine pouches have been added to § 36(2a) as a new prohibited product. Furthermore, all nicotine-containing products which fall outside the prohibition laid down in paragraph (2) but are intended for the consumption of nicotine have been fundamentally prohibited.
The newly added nicotine-containing products have also been included in the list of items that may be forfeit (cf. § 41).
In addition, the references to federal law in § 43a have been updated and a reference has been included to the notification procedure that is to be carried out.

9. The aim of the legislation is to further expand the protection of children and young people in the province of Salzburg. A need for this has arisen because consumption of nicotine pouches by young people has recently increased. Nicotine pouches are tobacco-free and smoke-free nicotine products that are intended for oral consumption. They are placed inside the upper or lower lip or in the cheek cavity for about 30 to 60 minutes. From here, nicotine, carried by substances such as cellulose, is absorbed via the oral mucosa, passing through the bloodstream into the entire body. Nicotine pouches are therefore simple and discreet to consume, as they are not apparent from the outside; they cannot be seen or smelt. Nevertheless, nicotine pouches contain addictive substances. Nicotine is one of the fastest addiction-inducing substances and is often underestimated – especially by young people. Nicotine pouches can have a very high nicotine content, meaning that more nicotine tends to be absorbed than when smoking cigarettes. The high nicotine content can lead to an overdose and nicotine poisoning. In order to protect children and young people from these health-damaging effects, possession, consumption and acquisition by children and young people are prohibited. Similarly, these products must not be offered, supplied or given to children and young people.
