5. Royal Decree amending the Royal Decree of 28 October 2016 on the manufacture and marketing of electronic cigarettes

8. This draft Royal Decree amends the Royal Decree of 28 October 2016 on the manufacture and marketing of electronic cigarettes.
The planned changes concern composition and labelling.

9. With regard to composition, Article 4 has been amended so that its provisions apply to nicotine-free disposable e-cigarettes. These provisions currently apply to nicotine-free e-liquids (via Article 6/1) but not to nicotine-free disposable e-cigarettes. (see Article 1 of the draft)
With regard to labelling (Article 5), some amendments have been made to rectify certain errors (Article 2, 4° and Article 3 of the draft). It has also been added that the leaflet must include information on smoking cessation, in accordance with Sheet 6.5 of the inter-federal strategy 2022-2028 for a smoke-free generation, dated 14/12/2022. (see Article 2, 3° of the draft)

In addition, a specific health warning is provided for nicotine-free disposable e-cigarettes. Previously, these had to carry the health warning provided for refill bottles and electronic cigarettes with nicotine, which was not logical. (see Article 2, 1° and 2° of the draft)
