5. Draft Decree on construction requirements
6. requirements for safety and properties of buildings (mechanical durability and stability), requirements for structural design, requirements for building equipment, special requirements for selected types of buildings (apartment buildings, family homes, commercial buildings, etc.)

The Building Act obliges legal entities and natural persons as well as administrative authorities to proceed according to general technical requirements for construction when designing, situating, permitting, building, approving, using and demolishing buildings. The draft regulates in more detail the basic requirements for buildings, namely mechanical durability and stability of safety in use, energy savings, thermal protection and more. These basic requirements are supplemented by additional requirements in individual cases. In addition to general formulations, they focus on more detailed technical design of building structures and building equipment, with specific details left to technical standards.

9. The reason for submitting the draft Decree on construction requirements is the obsolescence of the current Decree No 268/2009, as it no longer fully corresponds to the technical progress achieved in the given area since its publication. At the same time, Act No 283/2021, the Building Act, was passed, which establishes a new authorisation to adopt new implementing legislation (the Decree on construction requirements), which will replace the current Decree No 268/2009.
