5. Decree on the indication of the origin of meat applicable to catering establishments offering only take away or delivery meals

8. This Decree extends, beyond 29 February 2024, the obligation to indicate the origin or provenance of meat of swine, sheep and poultry species in commercial and mass catering establishments offering only take away or delivery meals.

Article 44 of Regulation 1169/2011 provides that, for foods offered for sale to the final consumer or to mass caterers without prepackaging, or where foods are packed on the sales premises at the consumer’s request or prepacked for direct sale, the provision of other particulars referred to in Articles 9 and 10 is not mandatory unless Member States adopt national measures requiring the provision of some or all of those particulars or elements of those particulars.
It follows from the provisions of that Article that Member States may require that, for non-prepacked foods, some or all of the particulars set out in Articles 9 and 10 of that Regulation, including the origin or provenance of the food, are indicated, on the sole condition of informing the European Commission immediately.

Accordingly, that draft Decree, adopted on the basis of Article 44, allows consumers to be clearly informed of the meat used for the preparation of dishes sold without prepackaging or with packaging at their request in catering establishments offering take away or delivery meals. Those provisions shall apply where the origin of such meat is known to the caterer pursuant to Regulation (EU) No 1337/2013.

Lastly, information on the origin or provenance helps consumers make informed choices so that they can make more sustainable purchases. It contributes to the coherence of the various European policies by giving the consumer the means to favour European products subject to high production standards meeting health and environmental requirements. It also responds to the Commission’s ambition of a European Green Deal, one of which will be the “Farm to Fork” strategy aimed at strengthening the sustainability of European agriculture by 2030.
