This draft standard is notified under the procedure laid down in Article 45 of Regulation (EC) No 1169/2011, given that the proposed new national legislation includes provisions on the labelling of edible vegetable oils, which are fully compliant with the applicable Community legislation.
8. The purpose of this Royal Decree is to lay down the quality standards applicable to the production and marketing of edible vegetable oils, with the exception of olive oils and olive-pomace oils, regulated by its specific standard. It furthermore lays down the names, characteristics and labelling provisions relating to the labelling of the oils covered by this provision.
This quality standard shall replace the standard currently governing these products, Royal Decree 308/1983, of 25 January 1983, adopting the Technical Health Regulations for Comestible Vegetable Oil.
This draft Royal Decree concerns industries that produce vegetable oils in Spain, the operators placing them on the market and consumers. It also has an indirect influence on the suppliers of the raw materials from which these products can be made.
9. Given the reality of the market in vegetable oils, it is necessary to adapt the specific rules on these products, especially as regards the production of vegetable oils in Spain, in terms of their food quality.
The purpose of updating the legislation on vegetable oils is to ensure high product quality, to prevent fraud within the sector, to adapt the legislation to the new demands and needs of industry and consumers, and to remove unnecessary restrictions on the production of vegetable oils in Spain; and in the context of the general framework for updating quality standards of the Ministry of Agriculture, Fisheries and Food.
The Spanish Government is empowered by Law 28/2015, of 30 July 2015, on the protection of food quality, to approve quality standards for food products, with the aim, inter alia, of adapting to European Union regulations, simplifying, modernising and enhancing existing rules and improving the competitiveness of the sector, including those brought forward by technological innovation.
