8. The e-services covered by the draft regulations are services for electronic identification and digital mail.

The services that are relevant in the field of electronic identification services are:
- Electronic identification: an automated check of who has identified themselves.
- Identification and certification function: a service where the supplier carries out automated checks, issues identity certificates, and sends the identity certificate to the public actor that ordered it.
- Electronic signature function: technical function in the eID to produce an advanced electronic signature.

‘Digital mail services’ refer to electronic postal delivery services and electronic mailboxes for conveying and making available digital mail sent from a public entity to an individual through the national inter-agency infrastructure for digital mail Mina meddelanden (My Messages), provided by the Agency for Digital Government.

The regulations propose requirements for suppliers’ application for connecting to authorisation schemes for electronic identification and digital mail.

The requirements mainly relate to the following:
- The details concerning the supplier to be provided in the application by the supplier;
- That the supplier must be established and registered in a country within the European Economic Area in accordance with that country’s rules on registration in trade and companies register, or similar registers;
- That the supplier must comply with the home country’s statutory requirements relating to registration for taxes and duties;
- That the supplier must have the necessary economic and financial capacity to fulfil, for at least one year, the obligations arising from the connection agreement;
- That the supplier shall hold valid business and liability insurances or other similar guarantees adapted to the supplier’s business; and
- The supplier shall undertake to conclude a connection agreement.

Upon request, the supplier shall provide evidence that it meets the requirements. There are special requirements for suppliers that are companies in the process of being set up.

Pursuant to Section 10 of the Act (2023:704) on authorisation schemes for electronic identification and digital mail services, a provider may, if necessary, rely on the financial, technical or professional capacity of other companies in the application (attached as supporting documentation).

Suppliers of electronic identification services must also be audited and approved by the Swedish Agency for Digital Government, in accordance with the Trust Framework for Swedish eID. The framework is based on international standards and entails a national application of the eIDAS Regulation.

Digital mail service providers shall be connected to the public inter-agency infrastructure for digital mail. The requirements for connecting to the infrastructure are regulated in the General Terms and Conditions for My Messages.

9. The aim of the draft is to regulate the requirements for approving providers’ application to join an authorisation scheme for electronic identification and digital mail services. The proposed requirements will enable the Agency for Digital Government to inspect the supplier and its services, allowing public operators to access robust, quality-assured, and joint public administration services for electronic identification and digital mail.

There is no harmonised regulatory framework for electronic identification services and for digital mail services covered by authorisation schemes for electronic identification and digital mail, respectively. It is, therefore, not deemed possible or appropriate to include a mutual recognition clause.
