The “Regulation concerning the protection of copyright on electronic communication networks and implementation procedures in accordance with Legislative Decree No 70 of 9 April 2003” referred to in Decision No 680/13/CONS was adopted by the Authority on 12 December 2013 and entered into force on 14 March 2014. The same was adopted following a comprehensive public consultation and takes into account the comments made by the European Commission in the context of
notification procedure No 2013/0496/I.
Subsequent notification procedures Nos 2018/0151/I,2020/0700/I and 2023/0123/I then notified through this Central Unit the amendments made to the same Regulation. The amendment which concerns us today and which we hereby intend to notify to the European Commission responds to the need to bring the Regulation into line with the significant changes introduced by the legislative body to the relevant regulatory framework, both EU and national (DSA, Omnibus Decree amending the Anti-Piracy Law and the new Consolidated Text for Audiovisual Media Services).
The proposed amendments are listed in Resolution No 47/25/CONS.

9. The proposed amendments respond to the need, expressed by the rightholders of audiovisual content broadcast live, not only sporting events, to intervene within a shorter period of time, through “dynamic injunctions”.
In implementing the amendments made by the Omnibus Decree to the Anti-Piracy Law, with particular reference to the recipients of the measures, greater protection is guaranteed even if the contents are disseminated through VPN services, publicly available DNS and search engines. For infringements of copyright and related rights by audiovisual media service providers, a sanctioning procedure is provided for in the new provisions of the Consolidated Law on Audiovisual Media Services.
