Regulation (EC) No 1924/2006 on nutrition and health claims made on foods: Article 23
The Nutri-Score label reflects the nutritional quality of products through a colour scale from dark green (A) to dark orange (E), calculated on the basis of a standard methodology that takes into account favourable and unfavourable nutrients.
Regulation (EU) No 1169/2011 on the provision of food information to consumers: Articles 40, 43, 44 and 45
Use of the Nutri-Score logo is voluntary and allows economic operators to display it on food packaging, both in physical retail premises and online, subject to compliance with the procedure established by the French national public health agency (Santé Publique France), the owner of the collective mark.
8. The draft Government Decision is aimed at approving the use of the voluntary Nutri-Score nutrition labelling system in Romania, in order to improve consumer information on the nutritional quality of marketed food products. The document sets out the legal and institutional framework necessary to implement this system, in accordance with Regulation (EU) No 1169/2011 and Regulation (EC) No 1924/2006 on nutrition and health claims made on foods. Use of the Nutri-Score logo is voluntary and allows economic operators to display it on food packaging, both in physical retail premises and online, subject to compliance with the procedure established by the French national public health agency (Santé Publique France), the owner of the collective mark. The Nutri-Score label reflects the nutritional quality of products, with a colour scale from dark green (A) to dark orange (E), calculated on the basis of a standard methodology that takes into account favourable and unfavourable nutrients. The document designates the National Authority for Consumer Protection (ANPC) as the institution responsible for applying and supervising the provisions of the Decision, in its capacity as Regulator. The procedure for use provides clear requirements for producers and distributors regarding correct registration, application and promotion of the Nutri-Score logo. The obligations regarding transparency, accuracy of nutrition data, respect for visual identity and conditions for withdrawal of the right of use in case of non-compliance are set out in detail. The Decision has been written up in accordance with the European notification procedure in the field of technical regulations and will enter into force 60 days after its publication in the Official Gazette (Monitorul Oficial). Through this Regulation, Romania joins those European states supporting the promotion of a healthy diet through clear and accessible nutrition information.

The legislative act is aimed at implementing the voluntary Nutri-Score labelling system in Romania by establishing a clear framework for its use by economic operators marketing food products, in both the physical and online environments. The purpose of the Regulation is to promote healthy nutrition and to support consumers in making informed decisions, through a simplified and visual presentation of the nutritional quality of products. At the same time, it creates the necessary conditions for coherent implementation of European provisions on nutrition information for consumers, in particular with regard to the use of additional forms of expression or presentation of the nutrition declaration, pursuant to Article 35 of Regulation (EU) No 1169/2011. The measure contributes to promoting healthy nutrition by providing consumers with easily understandable information about the nutritional quality of products, thereby supporting them in taking informed decisions. The Regulation also establishes the responsibilities of the competent authorities, in particular the National Authority for Consumer Protection, regarding monitoring of the correct application of the system and ensuring compliance with the conditions of use of the Nutri-Score mark.
