8. The Regulation deletes from the Chemicals Ozone Layer Regulation national provisions which have been included in the amended Regulation (EU) 2024/590 (§ 4). In addition, existing purely national recording and storage obligations for the withdrawal of ozone-depleting substances are deleted, as the existing obligations under circular economy law are sufficient (§ 3). Finally, in order to simplify matters, expertise for recovery, take-back and leak checks should in future only be provided by means of a certificate of expertise under the Chemicals Climate Protection Regulation (Section 5). Furthermore, the national derogation for certain asbestos-containing products in the Chemicals Prohibition Regulation is deleted, as the legal basis under EU law has ceased to exist.

The purpose of the Regulation is to adapt national law to Regulation (EU) 2024/590 by deleting provisions now contained in Union law and updating the editorial references to Regulation (EC) No. 1005/2009. In addition, simplifications are being made because, for example, the documentation obligations for the withdrawal of ozone-depleting substances are no longer necessary.
