8. This is a Collective Decree amending various provisions on energy and climate. In the context of this notification, Articles 25 and 33 of the Collective Decree are relevant. These provisions on building automation and control systems are considered to be technical regulations even if they themselves are already the result of the transposition of a European directive.

The 2018 EPBD Directive already required the installation of a building automation and control system in non-residential buildings with a space heating or cooling installation of at least 290 kW by 2025. The new 2024 EPBD Directive sets out a stricter requirement, which is also added here. For example, the threshold of 290 kW will be lowered to 70 kW by 31 December 2029, which will entail a major extension of the scope. In addition, building automation and control systems will also have to monitor indoor environmental quality. Article 1.1.3, 17° of the Energy Decree also includes the definition of ‘indoor environmental quality’ as defined by the EPBD Directive.

The Directive describes the requirements that building automation and control systems must meet, as well as the application of the 70 kW and 290 kW thresholds, only in scant detail. It is necessary to lay down more practical rules to this end. To this end, a delegation of powers to the Flemish Government is provided.

It is also provided that the Flemish Government may impose the obligation to install a building automation and control system the owner or user of the building or installation. This is because non-residential buildings are often let as a shell, with the tenant subsequently installing the complete installations. It is logical that the tenant is therefore responsible for providing those installations with a building automation and control system.

An obligation only makes sense if it is also possible to enforce it. This article provides the VEKA a legal basis for imposing an administrative fine on the person responsible for complying with the requirement. For the sake of uniformity, the range within which the fine must be set, between EUR 500 and EUR 200 000, was derived from the renovation obligation. This is broad enough to allow the VEKA to impose fines that are proportionate to the violation.
