The aim of this regulation is to improve the collection and processing of waste electrical and electronic equipment (WEEE) from companies through the introduction of a delivery obligation for disposers, a permit requirement for collectors, and a notification obligation for WEEE processors. Articles I, II and III may contain technical regulations.

Article I amends the Living Environment (Activities) Decree in connection with the introduction of an obligation to deliver WEEE for specific environmentally harmful activities.
Article II amends the Industrial Waste and Hazardous Waste Notification Decree in connection with the introduction of a notification obligation for the receipt of all WEEE from WEEE processors.
Article III amends the Waste Collection Decree in connection with the introduction of a permit requirement for WEEE collectors.

No provision of mutual recognition has been included as this is not possible. These are other requirements that are imposed indirectly on certain products that are in the waste phase (WEEE) and may affect the trade in these waste products.

9. This scheme aims to protect the environment and public health by ensuring that as much WEEE as possible is sent to approved processors. This is done by obliging companies carrying out certain environmentally harmful activities to deliver WEEE. The introduction of this delivery obligation for WEEE is necessary in order to prevent WEEE leak flows to non-approved WEEE processors with risks to the environment and public health. It is estimated that the total leak flow is approximately 100 000 tonnes of WEEE per year.

The delivery obligation for WEEE is both non-discriminatory and proportionate, because it applies to all companies that structurally produce an above-average amount of WEEE because of the activities they carry out, such as recyclers and companies that repair used products, metal recycling companies including scrap dealers, waste collection centres, construction companies, installation companies, data centres, laboratories and hospitals. The other requirements are appropriate for the protection of the environment and public health, because it is possible to verify whether waste electrical and electronic equipment ultimately reaches approved processors, so that enforcement is possible. They are also the least restrictive means because they create, in particular, administrative obligations.
