6. Requirements for the implementation of Regulation (EU) 2025/40, in particular concerning expanded manufacturer responsibility for packaging.

8. The purpose of the draft bill is to align national packaging law with the requirements of Regulation (EU) 2025/40 (EU Packaging Regulation). In particular, it regulates expanded manufacturer responsibility for packaging (packaging supply, approval of manufacturers and organisations for manufacturer responsibility, manufacturer registration, recycling requirements, reporting obligations) and the associated regulatory requirements (Central Agency Packaging Register, German Environment Agency). In addition, specific provisions are laid down for the deposit system and the recycled content of single-use beverage packaging and the mandatory offer of reusable packaging for the immediate consumption of food and beverages.

9. The provisions of Regulation (EU) 2025/40 shall apply from 12 August 2026. The Regulation differs from its predecessor, Directive 94/62/EC, in many respects. This calls for alignment with national packaging law.
