5. Draft Order of the Minister of the Environment of the Republic of Lithuania “On the Amendment of Order No D1-14 of 5 January 2011 of the Minister of the Environment of the Republic of Lithuania ‘On Approval of the Rules for the Management and Use of Wood Fuel Ash’”
6. The requirements for the use of ash and slag adopted by the Draft apply to all types of solid biofuel ash and/or slag. New criteria are also established under which this ash and/or slag will no longer be considered waste.

8. The Description of the Requirements for the Use of Solid Biofuel Ash and Slag proposes to establish that:
– solid biofuel ash may be used as a fertiliser in agriculture, provided that it is placed on the market, supplied and used in accordance with the conditions and requirements established in the Law on Fertilising Products;
– solid biofuel ash may be used on forest land, provided that the maximum permissible concentration of the chemicals it contains are in line with that specified in the Draft, and that it meets the other requirements specified in the Draft;
– solid biofuel ash and/or solid biofuel slag may be used in landfills (to cover layers of waste and as a filler or structural material for the construction of temporary roads in landfills);
– solid biofuel ash and/or solid biofuel slag may be used for the recultivation of damaged areas after soil testing has been carried out;
– solid biofuel ash and/or solid biofuel slag, and mixtures produced using them, may be placed on the market for use in construction, provided that they meet the requirements for placing construction products on the market, are included in the composition of materials used for the construction and/or reconstruction of roads, sites and/or other surfaces, and are stable and meet the established limit values;
– solid biofuel ash and/or solid biofuel slag may be used in the formation or construction of objects that are not classified as structures under the Law on Construction (e.g., landscaping, embankments, access roads or surfaces), provided that they do not exceed the maximum permissible concentration of chemical substances, are stable, and are used in mixtures or bound with binders to reduce the generation of ash dust and the leaching of heavy metals into the environment;
– solid biofuel ash is to be used on forest land, and solid biofuel ash and/or solid biofuel slag is to be used for the recultivation of damaged areas, in landfills, in construction and for other purposes, in accordance with the plan for the use of solid biofuel ash and/or slag;
– requirements for soil testing, and requirements and methods for testing solid biofuel ash and/or solid biofuel slag, are to be established;
– requirements for the preparation and submission of a plan for the use of solid biofuel ash and/or slag are to be established;
- ash and/or slag that meets the end-of-waste criteria and is no longer considered waste is to be exempted from registration under the REACH Regulation if it meets the criteria established in Article 2(7)(d) of said Regulation.
The Description of the End-of-Waste Criteria for Solid Biofuel Ash and Slag proposes establishing a system of criteria under which solid biofuel ash and solid biofuel slag may cease to be classified as waste once they have been processed (for example, by removing impurities, ageing the ash and slag, and so on). The aforementioned criteria system would ensure the proper initial processing and upgrading of solid biofuel ash and solid biofuel slag, would establish an obligation to have a quality management system in place and to use permitted waste‑utilisation processes and methods, which, once implemented, would mean that solid biofuel ash and solid biofuel slag would no longer be considered waste, and would allow these materials to benefit from the registration exemption provided for in the REACH Regulation.
9. The Draft aims to improve the legal framework to allow solid biofuel ash and/or solid biofuel slag to be placed on the market and used for specified purposes as products, and to establish end‑of‑waste criteria.
