The Preliminary Draft Bill fully transposes into national law two EU Directives: Directive (EU) 2024/825 of the European Parliament and of the Council of 28 February 2024 amending Directives 2005/29/EC and 2011/83/EU as regards empowering consumers for the green transition through better protection against unfair practices and through better information and Directive (EU) 2024/1799 of the European Parliament and of the Council of 13 June 2024 on common rules promoting the repair of goods and amending Regulation (EU) 2017/2394 and Directives (EU) 2019/771 and (EU) 2020/1828.
Furthermore, a series of additional measures are included to promote conscious and sustainable consumption, empowering consumers to make their purchasing decisions in a way that best protects their economic interests, as well as ensuring equitable access to public performances and recreational activities.

Directives (EU) 2024/825 and 2024/1799, which transpose this Sustainable Consumption Act, aim, among other things, to further develop the policies already implemented by the European Union in the areas of sustainability and circularity and to increase consumer protection against unfair commercial practices.
The inclusion of a measure limiting the advertising of products and services that run exclusively on fossil fuels seeks to consistently support efforts towards a sustainable energy transition. While these products have played an important role in economic and social development, it is necessary to begin reviewing the way in which they are promoted, especially in a context where cleaner and more efficient alternatives are being actively promoted. This measure is not intended to abruptly discourage their use, but rather to encourage a gradual change in perception and consumer decision-making.
Moreover, advertising has a significant influence on people’s habits and aspirations. Therefore, it is reasonable that the advertising space reflects the environmental commitments being adopted from public policies. By setting certain limits on the promotion of emission-intensive products, the aim is to foster an environment more conducive to the development of sustainable technologies, without disproportionately affecting productive sectors or citizens’ freedom of choice. Therefore, the goal is to move toward commercial communication that is more in line with sustainability objectives.
On the other hand, it is also considered necessary to provide greater transparency in the use of dynamic pricing systems by companies. To this end, the Unfair Competition Law is being amended so that consumers can know, when using these services, the range of prices they will have to pay at the time of purchase.
