The increase in the consumption of stimulant energy drinks among young people under 16 years of age, and their consumption in inappropriate contexts is causing concern among public authorities and the scientific community due to the potential health risks. Added to this is the absence of specific regulations that comprehensively define these beverages, specify authorised substances and maximum concentrations and combinations, as well as the rise of new channels of access through digital services and the deployment of advertising and promotion strategies aimed at young audiences.
Various organisations have warned about the adverse effects associated with stimulant energy drinks.
In response to recommendations to limit the consumption of these beverages among children and adolescents, and in accordance with the principle of enhanced protection of the health of young people under 16 years of age and the principles of prevention and precaution governing the protection of vulnerable consumers, a specific regulatory intervention is necessary.
This standard pursues this objective by:
(i) establishing limitations on the sale and supply of energy drinks with a stimulating effect to young people under 16 years of age and on their consumption by this age group;
(ii) implementing restrictions on advertising, promotion and sponsorship, prohibiting messages aimed at persons under the age of 16; and
(iii) coordinating preventive and educational measures, with a comprehensive approach, through campaigns, programmes and actions in order to provide information and raise awareness in the areas of health, consumption, education, sport, youth and commerce.
9. The purpose of the law is to strengthen the protection of the health of persons under 16 years of age, in their condition as vulnerable consumers, by regulating the sale, supply and consumption of energy drinks with a stimulating effect, as well as their advertising, promotion and sponsorship.
The objective of protection is articulated through actions to prevent, sensitise and control the access of young people under 16 years of age to energy drinks with a stimulating effect, minimise the risks associated with their consumption and promote healthy lifestyle habits, with the participation of the family environment, public administrations, public and private entities, economic sectors and social organisations concerned.
