8. Directive No. 2008/98/EC on waste introduced the possibility for substances or objects that have the status of waste to cease to be waste when they have undergone a recovery operation and meet specific criteria.

In this context, the draft decree lays down the criteria for removing the waste status for thermolysis oil from tyre waste vapothermolysis or thermolysis. The thermolysis oil concerned is intended for material use in a petrochemical or chemical plant. A petrochemical or chemical plant is a facility for manufacturing or producing goods through chemical processing. In France, these plants are classified under heading 3410, 3420, 3680 or 2640 of the nomenclature of plants classified for environmental protection annexed to Article R. 511-9 of the Environmental Code.

9. The purpose of this draft decree is to eliminate the waste status of thermolysis oil from the vapothermolysis or thermolysis of tyre waste which:
– complies with the criteria laid down by the decree. These relate to the composition of the tyre waste accepted in the thermolysis or vapothermolysis operation and the quality of the oil produced;
– complies with the technical specifications specific to each plant that uses it. These specifications shall be defined on the basis of prior testing;
– are the subject of a transfer contract with the petrochemical plant that uses it;

The oil lots must then be identified by a unique number and the thermolysis or vapothermolysis plant reference, in order to ensure traceability. The operator must also implement a quality management system covering the various management operations for this waste.

All of these criteria have been defined in accordance with Article D541-12-11 of the Environmental Code transposing Article 6 of Directive 2008/98/EC. The criteria for removing the status of waste therefore include:
‘a) authorised waste used as input for the recovery operation;
b) authorised processing processes and techniques;
c) the quality criteria applicable to the materials resulting from the recovery operation which cease to be waste, in accordance with the relevant product standards, including, if necessary, limit values for pollutants;
d) requirements for management systems to demonstrate compliance with the criteria for the removal of waste status, in particular in terms of quality control and self-monitoring, and accreditation, where appropriate; and
e) the requirement of a declaration of conformity;’
