For the equivalence clause, reference is made to Section C1 “General” of the published version of the MVV TB, issue 2025/1 (cf. 2025/0023/D) and Section 85a(1), third sentence, Model Building Code (cf. 2022/0720/D and 2025/0019/D).
9. Update of the Model Administrative Regulations on Technical Building Regulations, taking into account new findings and new technical rules:
there are among other things, technical innovations arising from changes in existing standards or new standards are considered for inclusion in MVV TB 2026/1 so as to reflect current best practice. Furthermore, textual clarifications have been made to improve application, along with simplifications aimed at reducing construction costs.
The notification is made on behalf of the 16 federal states of the Federal Republic of Germany.
9a. The Model Construction Code (MBO; cf. 2025/0019/D) contains, in Section 85a(1), the authorisation to specify, within the framework of an administrative provision, the general requirements for structural installations, construction products and other installations and facilities by means of technical building regulations. In the context of the notified provision, the specifications are made by reference to technical rules and their sources, in particular in relation to, for example, the planning, design and execution of structural works and their parts, characteristics and performance of construction products in certain structural works or their parts, or procedures for determining the performance of a construction product which does not bear the CE mark under the Construction Products Regulation. In this respect, the MVV TB is suitable for specifying the requirements of the model building regulations.
9b. The notified provision is based on the legal authorisation set out in the law governing building regulations, namely the Model Building Code. The notified provision constitutes a practical set of rules designed to ensure that buildings are constructed in accordance with the minimum requirements of building regulations, with a view to averting danger and with the aim of protecting human life and limb as well as the natural environment. The design requirements for the national safety level as well as for the fulfilment of the basic requirements for construction works are defined. In this respect, the notified provision contributes to construction that is technically safe and legally compliant. Where the requirements of building regulations as regards averting any danger are specified in the present case is the least restrictive method of achieving the desired objective.
9c. The principle is that only such content is included in the notified provision as the technical building regulations that are essential for fulfilling the requirements of the building regulations for building structures, construction products and other installations and facilities and are proportionate to the desired objective.
