7. - Directive 94/62/EC on packaging and packaging waste

8. The ordinance amendment essentially transposes into national law the requirements of Directive (EU) 2018/852 amending Directive 94/62/EC on packaging and packaging waste and Directive (EU) 2019/904, specifically concerning packaging.
In addition, requirements of Directive (EU) 2018/851 amending Directive 2008/98/EC on waste are being transposed in relation to extended producer responsibility schemes for packaging.
Furthermore, substantial parts of Directive (EU) 2019/904 on the reduction of the impact of certain plastic products on the environment (SUP Directive) are being transposed.
Some updates, adjustments and changes are also being made to simplify and improve enforcement.

9. Directive (EU) 2019/904 on the reduction of the impact of certain plastic products on the environment entered into force on 2 July 2019. The aim of the Directive is to reduce plastic waste generation in order to prevent and reduce the impact of plastic waste on the environment, especially on the marine environment. This Directive affects single-use plastic products most frequently found on European beaches, fishing gear containing plastic and oxo-degradable plastic. Various measures are envisaged for the various groups of plastic products, in particular extended producer responsibility and minimum recycling targets.

The new recycling targets laid down in Directive (EU) 2018/852 are already largely met in Austria. Additional effort is required only to achieve the target for plastic packaging, which has been more than doubled. Certain measures are envisaged for this purpose:
• For household collection, all plastic packaging is to be collected separately in future throughout Austria.
• Commercial waste generation sources are to separately record the packaging generated and hand over licensed packaging to the collection and recycling systems.
• Collection and recycling systems are to ensure there are sufficient sorting and recycling measures.
• Plastic packaging is to be reusable or recyclable from 2030 onwards.

Directive (EU) 2018/851 amending Directive 2008/98/EC on waste makes various additions to extended producer responsibility, for example in Article 8a. The aim of the draft is to transpose into Austrian law the requirements arising from Article 8a, in particular concerning packaging. This also includes enabling the appointment of authorised representatives in Austria for foreign producers or distance selling merchants.
