8. Article 13 of the Law against waste and for a circular economy (known as the AGEC Law) introduced consumer information provisions on the presence of dangerous substances.
The draft regulatory text aims to identify dangerous substances with a view to imposing measures to inform consumers about their presence in waste-generating products.
Dangerous substances are identified as:
- substances of very high concern within the meaning of Regulation (EC) No 1907/2006
- substances presenting a level of concern comparable to substances of very high concern. The list of these substances and its update are set by order of the Minister for the Environment after consulting the French Agency for Food, Environmental and Occupational Health and Safety.

In its opinion issued on 5 October 2020, the French Agency for Food, Environmental and Occupational Health and Safety (ANSES) confirms that substances of very high concern constitute a relevant base for this Decree and states that ‘the experience acquired in the course of previous expert appraisal work carried out […] as part of its health safety missions with regard to exposure to chemical substances’ corroborates the need to ‘[supplement] this list with other updating mechanisms, based on recommendations [from ANSES], in particular for substances destined to be added to the SVHC list or which fall outside the REACH regulatory framework.’

The first order of the Minister for the Environment establishing a list of substances presenting a level of concern comparable to substances of very high concern will be notified to the Commission.

9. In order to allow consumers to make informed choices, the legislator wished to improve information on the presence of dangerous substances that could have an impact on health and the environment.
