The technical standard lays down the safety requirements and the specifications relating to the design, construction, installation, assembly, disassembly, operation, handling, maintenance and inspection of amusement devices and equipment, with a view to the safety of passengers, users and employees, taking into account and adopting the requirements of the new harmonised European standard EN 13814.
In terms of drawing up the draft technical standard, it should be noted that Decision 104922 - 16 October 2019 of the Secretary-General for Industry set up a technical working group in order to draft a technical safety regulation concerning the installation, operation and inspection of fixed and mobile amusement parks (fairgrounds). The working group included four representatives of the Secretariat-General of Industry, representatives of the economic stakeholders (associations of fairground businesses), the Technical Chamber of Greece, the Hellenic Accreditation System (HAS - a legal entity), the National Quality Infrastructure System (NQIS)/Hellenic Organisation for Standardisation (HOS) and the Hellenic Association of Accredited Certification and Inspection bodies (HellasCert).

As there are no technical specifications or operating rules for this type of machinery, equipment or structures (amusement devices), there is an urgent need for the adoption of this Regulation for reasons of safety, the protection of public health and the safety of individuals/consumers making use of such amusement equipment and machinery. This technical regulation is a prerequisite for the establishment of procedures for authorising activities with an amusement content (licensing).

12. The draft is being notified under the urgency procedure for the following precautionary reasons:
(1) In order to deal immediately with accidents and incidents which have occurred in amusement areas equipped with equipment of this type (fairgrounds), where children who are minors have been victims, as, in the absence of a technical safety standard or a licensing framework for these activities, it is extremely difficult and time-consuming to investigate them and to apportion liability. This fact has also been noted by College of Public Administration Auditors/Inspectors, which in a confidential notification of reports on inspections carried out at fairgrounds pointed to the need for a legislative initiative to establish technical specifications and standards for such equipment, as well as a framework for the licensing of their activities. The fact that the technical standard is based largely on the requirements of the harmonised European standards in the recent 13814 series simultaneously strengthens and simplifies the examination of the relevant request.
(2) As there are no technical specifications or operating rules for machinery, equipment or structures of this type (amusement devices), there is an urgent need for the adoption of this Regulation on safety, for reasons of protection of public health and the safety of individuals/consumers making use of such amusement equipment and machinery. This technical regulation is a prerequisite for the establishment of procedures for authorising activities with an amusement content (licensing). Any new approval of an activity with amusement content should be based on compliance with the safety requirements of the Regulation currently being approved. The first requirement is already being met by means of the draft technical regulation being submitted now. The need to create the whole package of measures - technical regulation and licensing framework - in a short period of time requires the submission of the first part of this initiative under the urgency procedure.
