5. Implementing Decree on the requirements for milled cereal products, pasta, bakery products, and confectionery products and doughs

The purpose of submitting a new draft Implementing Decree is to adapt the requirements for milled cereal products, pasta, bakery products, and confectionery products and doughs to new scientific knowledge and technological developments in the food industry and to the directly applicable European Union legislation.
The changes to the existing provisions are also related to amendments to the relevant legislation, in particular the amendment to Act No 110/1997 on foodstuffs and tobacco products and on amendments to certain related acts, and to new legislation, such as Implementing Decree No 417/2016 on certain methods for labelling foodstuffs. The need for some of the amendments and refinements arose from practical experience.
The first part of the Implementing Decree provides definitions of milled cereal products, pasta, bakery products, confectionery products and doughs. This is followed by provisions laying down further requirements for the classification of products into groups and subgroups and specifying the sensory and physical quality requirements.
The draft Implementing Decree does not transpose any European Union directives.

The Draft refers to the following directly applicable EU legislation:
Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety, as amended.
Regulation (EC) No 852/2004 of the European Parliament and of the Council of 29 April 2004 on the hygiene of foodstuffs, as amended.
Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007, as amended.
Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council, and repealing Commission Directive 87/250/EEC, Council Directive 90/496/EEC, Commission Directive 1999/10/EC, Directive 2000/13/EC of the European Parliament and of the Council, Commission Directives 2002/67/EC and 2008/5/EC and Commission Regulation (EC) No 608/2004, as amended.

The key reason for submitting the new draft Implementing Decree is to adapt the requirements for milled cereal products, pasta, bakery products, confectionery products and doughs to new scientific knowledge and technological developments in the food industry and to the directly applicable European Union legislation.
The need for the proposed legislation arose from experience gained by practical application of the existing Implementing Decree No 333/1997 of the Ministry of Agriculture implementing § 18(a), (b), (g), and (h) of Act No 110/1997 on foodstuffs and tobacco products and on amendments to certain related acts, for milled cereal products, pasta, bakery products, and confectionery products and doughs, as amended. This Implementing Decree will be replaced by the new legislation.
The changes to the existing provisions are also related to amendments to the relevant legislation, in particular the amendment to Act No 110/1997 on foodstuffs and tobacco products and on amendments to certain related acts, and to new legislation, such as Implementing Decree No 417/2016 on certain methods for labelling foodstuffs. The need for some of the amendments and refinements arose from practical experience.
The reason for issuing a new Implementing Decree is the fact that even though Implementing Decree No 333/1997 of the Ministry of Agriculture has been amended several times, it still does not correspond to the current requirements of food business operators or the needs of market surveillance. The new Implementing Decree will also bring benefits to consumers. In terms of legal certainty, the updated content of the original Implementing Decree will also be appreciated by food business operators. The introduction of new product categories was mostly initiated by food business operators and their associations (unions).
