5. Government Decision amending and replacing Annex 5 - Regulation regarding technical approval for new products, procedures and equipment in constructions - to Government Decision No 766/1997 approving certain regulations concerning quality in constructions, with its subsequent amendments and additions

This draft decision is a re-wording of the Regulation regarding technical approval for new products, procedures and equipment in constructions, stipulated in Annex 5 to Government Decision No 766/1997 approving certain regulations concerning quality in constructions, with its subsequent amendments and additions, which no longer meets the current requirements and contains chapters regarding the content of technical approval in constructions, organising activities relating to technical approval in constructions, obligations and responsibilities pertaining to manufacturers, bodies responsible for issuing technical approvals in constructions, specialised groups and technical specialist committees, as well as the framework content of technical approval in constructions, technical endorsement and technical endorsement extension.
Technical approval in constructions is a favourable technical opinion, expressed in a written document, on the ability to use certain products or sets, hereafter referred to as construction products, which are not subject to a technical specification, in accordance with the fundamental requirements applicable to constructions that are stipulated in Article 5(1) of Law No 10/1995.
Technical approvals in constructions are drawn up by bodies authorised by the Ministry of Regional Development and Public Administration, at the request of the manufacturers or their authorised representatives.

This draft decision is a re-wording of the Regulation regarding technical approval for new products, procedures and equipment in constructions, stipulated in Annex 5 to Government Decision No 766/1997 approving certain regulations concerning quality in constructions, with its subsequent amendments and additions, which no longer meets the current requirements and contains chapters regarding the content of technical approval in constructions, organising activities relating to technical approval in constructions, obligations and responsibilities pertaining to manufacturers, bodies responsible for issuing technical approvals in constructions, specialised groups and technical specialist committees, as well as the framework content of technical approval in constructions, technical endorsement and technical endorsement extension.
To ensure that the regulation can be easily used, Annex 5 - Regulation regarding technical approval for new products, procedures and equipment in constructions - to Government Decision No 766/1997, shall be amended and replaced with the Annex that is an integrated part of this draft decision.

9. The regulation shall be re-worded by:
- replacing the phrase ‘technical approval for new products, procedures and equipment in constructions’ with the phrase ‘technical approval in constructions’ to ensure harmonisation with the provisions of Law No 10/1995 regarding quality in constructions, republished, with its subsequent amendments and additions, as well as with the provisions of Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC, which uses the phrase ‘construction products’;
- replacing the phrase ‘National Commission for Technical Approval in Constructions’ with the phrase ‘Permanent Technical Council for Constructions’, an entity without legal personality that is attached to the Ministry of Regional Development and Public Administration and was set up pursuant to Article 3 of Government Decision No 622/2004 establishing the conditions for placing construction products on the market, republished, with its subsequent amendments and additions;
- adding the statement that ‘any assays or tests required in order to issue technical approvals shall be carried out in laboratories accredited by a national accreditation body, for the purposes of and in accordance with the provisions of Regulation (EC) No 765/2008, for the assays or tests stipulated in the respective technical approval’;
- adding the statement that ‘the body responsible for issuing technical approvals in constructions shall also be responsible for selecting the laboratories where such assays and tests are to be performed on construction products’;
- replacing the phrase ‘products for which technical approvals have been issued shall also be subject to conformity certification activities’ with the phrase ‘construction products for which technical approvals have been issued shall undergo factory production control in order to retain the quality and consistency of the relevant characteristics during the manufacturing process’;
- presenting in detail the organisational structure of the bodies responsible for issuing technical approvals in constructions, mentioning the areas in which the specialist groups operate;
- presenting in detail the organisational structure of the technical specialist committees which endorse the technical approvals in constructions;
- presenting in detail the framework content of the technical approval in constructions stipulated in Annex No 1 to this regulation;
- presenting in detail the framework content of the technical endorsement stipulated in Annex No 2 to this regulation;
- presenting in detail the framework content of the technical endorsement extension stipulated in Annex No 3 to this regulation.
