5. Amendment of Act XLII of 1999 on the protection of non-smokers and certain rules on the consumption and distribution of tobacco products and of Act CXXXIV of 2012 on the suppression of juvenile smoking and the retail sale of tobacco products

8. The draft in question extends certain registration, labelling and marketing standards for tobacco products to the categories of products indicated in the subject.
The new regulation includes the following provisions:
- It extends the reporting and registration obligations of manufacturers and distributors to electronic devices imitating smoking, nicotine-free refill containers and cartridges, nicotine-free cartridges and nicotine-containing products that replace smoking.
- It allows the Government of Hungary to require the placing of combined warnings and health warnings on the packaging of nicotine-free refill containers, nicotine-free cartridges and nicotine-containing products, as well as other conditions for their distribution and control, through the promulgation of a government decree.
- It extends the requirements for authorisation for the marketing of tobacco products, bans on advertising and distance selling, as well as designated smoking sites for electronic devices imitating smoking, nicotine-free refill containers and cartridges, nicotine-free cartridges and nicotine-containing products that replace smoking.
- It extends restrictions on wholesale and retail distribution of tobacco products, restrictions on marketing only in National Tobacco Stores and banning sales to people under 18 years of age for nicotine-free refill containers and nicotine-free cartridges.
9. Taking into account the trends in smoking, the evolution of consumption patterns and the emergence of new recreational products containing dangerous amounts of nicotine, which can cause serious poisoning and death, it is necessary to regulate the consumption of ingredients, packaging and control of consumption of products that pose a serious risk to the health of consumers and those around them.
