8. The Mobility Orientation Act (LOM) of 26 December 2019 aimed in particular at facilitating and encouraging the deployment of new solutions to enable everyone to get around. Article 31 of the Act provides for legislation to be adapted by order to take account of the use of automated vehicles on public roads, in particular by defining the applicable liability regime. Order No 2021-443 of 14 April 2021 lays down this liability framework and the conditions for putting these systems into service on
public roads.
The Decree sets out the terms and conditions for the application of Article 6 of Order No 2021-443 of 14 April 2021 relating to the criminal liability regime applicable in the event of the use of a self-driving vehicle and its conditions of use. As regards automated road freight transport systems, it lays down the safety rules and safety demonstration procedures applicable to such systems. It defines the roles of the service organiser, the system designer and its operator, as well as those of the approved qualified bodies. It sets out the responsibilities of the technical department for ski lifts and guided transport with regard to automated road freight transport systems.
The safety demonstration procedure described in the draft Decree is compatible with Commission Implementing Regulation (EU) 2022/1426 of 5 August 2022 laying down rules on the application of Regulation (EU) 2019/2144 of the European Parliament and of the Council as regards uniform procedures and technical specifications for the type-approval of automated driving systems (ADS) of fully automated vehicles.

9. Order no. 2021-443 of 14 April 2021 lays down in law the liability regime and conditions for the use of self-driving systems in vehicles and automated road transport systems.
Decree No 2021-873 of 29 June 2021 clarified the regulatory framework applicable to these systems with regard to passenger transport. Orders were then issued (August and December 2022), to finalise the measures provided for in the Decree (authorisation of remote workers, approved qualified bodies, mandatory information to be given to the consumer).
In accordance with Article 6 of Order No 2021-443 of 14 April 2021, a Decree must be issued to define the regulatory measures relating to automated freight transport and logistics.
The issuing of this Decree is an important step in completing French regulations on automated road transport, and in providing clarity for freight transport ecosystems and automated solutions. This is one of the four main areas of focus of the 2022-2025 Automated and Connected Road Mobility strategy, published last February.
