5. Amendment to Minister of Economic Affairs and Communications Regulation No 118 of 1 December 2009 on ‘Technical requirements for radio equipment used on the basis of a frequency authorisation’

Annexes of the draft set out technical requirements for the following radio equipment for radiocommunication services: for radio-broadcasting, land mobile communications, aerial communications, stationary communications, satellite radionavigation, program delivery, marine communications and satellite communications.

8. The draft lays down technical requirements for radio equipment used on the basis of frequency authorisation.
The specific technical requirements for radio equipment are set out in Annexes 1–5 and 7, indicating the radio frequency band to be used, channel spacing, radiation standards, modulation and the assumptions for radio frequency planning. The relevant harmonised standards have been presented; these are recommended for use in the conformity assessment of radio equipment. The informative part states the notification number received upon notification to the European Commission.

Annexes 1–5 and 7 of the draft Regulation set out specific requirements for radio equipment, which are divided into normative and informative parts. The normative part lays down the conditions and technical requirements (radio frequency band used, bandwidth, radiation norms, modulation) for the use of radio equipment and preconditions for planning radio frequencies. The informative part states relevant harmonised standards recommended for use in the conformity assessment and certification of radio equipment and states the notification number received upon notification to the European Commission.

The part concerning specific requirements has been divided into paragraphs for each type of equipment for radio communication services and short range devices, and its structure with regard to radio communication services and objectives for the use of radio frequency bands is in accordance with Electronic Communications Committee (ECC) Decision CEPT/ECC/DEC/(01)03 and the European Communications Office's (ECO) Frequency Information System.

Annexes 1–5 and 7 are in accordance with the radio interfaces form drawn up in 2008 by the Joint Working Group of the Telecommunications Conformity Assessment and Market Surveillance Committee (TCAM) and the Radio Spectrum Committee (RSC) of the European Commission.

Annexes 6 and 8 to the Regulation remain unchanged and are therefore not notified in this Communication.

The amendment to the Regulation is necessary in order to harmonise frequency bands’ availability, their terms of use, and technical requirements for radio equipment with EU law and the regulations of the ECC of the European Conference of Postal and Telecommunications Administrations (Conférence Européenne des Administrations des Postes et des Télécommunications — CEPT) in accordance with International Telecommunication Union’s (ITU) Radio Regulations (hereinafter Radio Regulation) amending the Statute and the Convention.

The draft Regulation was prepared in consideration of the requirements established in the decisions of the European Commission and the decisions and recommendations of the ECC of the CEPT. The requirements for radio equipment of aeronautical communications also comply with Annex 10 ‘Aeronautical telecommunications’ to the ICAO (International Civil Aviation Organization) Convention.
