8. The purpose of this draft Royal Decree is to amend certain provisions of the Royal Decree of 21 April 2007 on breath testing and breath analysis equipment.

When police check blood alcohol levels, it is provided that the minimum volume required for each exhalation in a breath test or breath analysis will now be 1.2 litres, and no longer 1.9 litres. In addition, provision is made for abolishing the 15-minute waiting time for a breath test or breath analysis without prior testing.

9. The purpose of this draft Royal Decree is to simplify the procedure of police checks, while retaining their effectiveness.

We want the minimum volume required for each exhalation to be 1.2 litres and no longer 1.9 litres. At 1.9 litres, some people have difficulty exhaling this volume, or even fail to do so, and blood tests have to be carried out, which results in loss of time and also in practical challenges for the police services. The 1.2 litre volume will make it easier for people to exhale, and the current devices are powerful enough to deal with this volume.

It should be noted that we also wish to incorporate the ‘End of the Breath’ principle into our draft, i.e. the persons subject to the test will have to exhale as much as they can. As explained above, thanks to the technology used by the current devices, the limit of 1.2 litres is sufficient to obtain convincing results, but it is always a good idea for the person to exhale as much as they can.

When it comes to the now abolished 15-minute waiting time, there is no longer any need to maintain this waiting time with modern devices because they are perfectly capable of detecting and taking account of alcohol levels in the mouth without the need for this 15-minute waiting time. This change may mean significant amount of time saved for police services during their blood alcohol checks.
