8. §§ 1 to 22 of the draft relate to notification under Directive (EC) No 94/62 on packaging and packaging waste.

§§ 3-11 and § 15 of the draft relate to notification under the Information Procedure Directive 2015/1535 (EU).

The draft provides for an obligation for producers who place packaging on the market to register themselves or their representative in a register of producers, cf. §§ 3 to 9 of the draft.

The draft also provides for an obligation for the producer to report information on expected quantities of packaging placed on the market to the producer register organisation (Danish Producer Responsibility), cf. § 10 of the draft, and an obligation to pay a fee for registration, cf. § 11 of the draft.

‘Producer’ is defined in § 2 subparagraph 11 of the draft.

In addition, the draft contains provisions on self-monitoring of producers, collective schemes, administrative cooperation and retention of documents by the Danish Environmental Protection Agency and the Danish Data Centre for Circular Economy, and provisions on supervision, appeals and penalties.

9. The main aim of the draft is to introduce regulations on a producer register and the reporting of information on packaging, which is necessary to be able to establish, within the implementation deadline, an extended producer responsibility scheme for packaging, including certain single-use plastic products, in accordance with Article 7(2) of Directive (EC) No 94/62 on packaging and packaging waste with implementation deadline 31 December 2024 and Article 8 of Directive (EU) 2019/904 on the reduction of the impact of certain plastic products on the environment.

The rules on the actual organisation of the extended producer responsibility will be introduced later in 2024.
