8. The draft Royal Decree aims to regulate the advertising of sexual services disseminated either online (on internet platforms) or offline (written press).

On 1 June 2022 the new Sexual Criminal Code entered into force, including a decriminalisation of sex work.
Under the new Sexual Criminal Code (Article 433c/2), the advertising of prostitution is only permitted on Internet platforms, newspapers or magazines “specifically provided for this purpose”.

The draft Royal Decree sets out the applicable framework and the manner in which the advertising of prostitution may be authorised. Providers, which disseminate advertising on internet platforms or any other medium or part of support, will be authorised provided that they undertake to report to the police immediately any exploitation cases of which they are aware.

In addition, providers (of advertising space) will have to comply with certain measures such as providing sex workers with useful information to ensure their protection, as well as certain measures to prevent and detect abuses related to prostitution and trafficking in human beings.

9. The reform of sexual criminal law aimed, among other things, to remove consensual sex work from the grey area in which it was.

However, it was the legislator’s intention to regulate the practices of the sex work sector in order to prevent and combat abuses and situations of exploitation. This is the case with regard to advertising relating to offers of a sexual nature.

Thus, although the new sexual criminal law incorporates a general principle of prohibition of the advertising of sexual offers and imposes a penalty on them, it nevertheless provides for exceptions.

Sexual criminal law therefore allows providers of an internet platform or other material specifically intended to publish sexual advertisements provided that, and exclusively if, those advertisements are published in accordance with certain conditions which are intended, inter alia, to protect sex workers, and to prevent and combat abuse and the risk of sexual exploitation.

The purpose of the draft Decree is to detail the arrangements referred to above.
