8. Foodstuffs with a period of minimum durability of more than 48 hours, as specified in separate regulation, shall not be placed on the market as foodstuff within 48 hours before the date of minimum durability pursuant to Section 15 (which is to be amended, more specifically supplemented), excluding cases of interests of food safety, food supply security and consumer protection, as well as cases where the product is made available free of charge and the requirements of point (a) in Chapter V of Annex II of Regulation (EC) No 852/2004 of the European Parliament and of the Council are met.

Food categories which may not be placed on the market as foodstuff within 48 hours before the date of minimum durability and which should be offered and may be offered through the Food Rescue Database are as follows:

2. Poultry meat
3. Pork, beef and other meat
4. Fish, canned fish
5. Meat products
6. Milk, sour cream and substitutes thereof
7. Yoghurt and other acidified preparations
8. Other dairy products
9. Cheese and substitutes for cheese
10. Butter, margarine and preparations thereof
11. Other fats (vegetable and animal)
12. Ice-creams
13. Eggs and egg products
14. Bread
15. Pastry
16. Pasta, rice, other cereals
17. Flour, sugar
18. Honey
19. Cocoa, chocolate and confectionery products
20. Preserved bakers’ wares
21. Fresh and processed vegetables, fruits and mushrooms and plant-based food
22. Fruit and vegetable juices
23. Canned food, pickles
24. Quick-frozen products
25. Spices, seasonings
26. Coffee and cocoa powders
27. Tea
28. Mineral waters and soft drinks
29. Dietary supplement

9. Experiences of the past two years since the entry into force of Act XLVI of 2008 on the food chain and its official supervision (which is to be amended) and the events that have occurred in the meantime (such as the historical drought in 2022 or the Russian-Ukrainian war which broke out in the neighbourhood of Hungary before that) urge to pay ever more attention to the scale of food waste, and remind of the importance of significantly reducing waste and of the particular importance of delivering the rescuable food to those in need.

The draft contains provisions on commercial foodstuffs.
