5. Proposed amendments to the Norwegian Marketing Control Act - strengthening children's digital consumer protection
6. The proposal comprises requirements for marketing in social media and digital games - e.g. information society services.

8. The proposal includes a new provision in the Marketing Control Act which states that
"§21 a. Marketing in social media, etc.
Marketing which there is reason to expect to be seen or heard by children on social media and in games shall not contain mention of, film or images of or references to products unsuitable for children.
The Ministry may by regulations determine which products and assessment criteria are covered by the first paragraph."
The proposal will be in line with the established system of the Marketing Control Act as regards jurisdiction and regulated entities ("traders").
The Consumer Authority will be tasked with assessing which products are unsuitable for children according to the proposal. The proposal stipulates assessment criteria, including views of ethics and morality in the general population. Relevant assessment criteria are danger to health (physical or mental), safety, if the product legally can be sold to children or if its use by children is discouraged. Traders will according to the proposal need to take appropriate measures to avoid that children are exposed to marketing of such products in social media and games, or refrain from marketing such products in these media.
In addition, it is proposed to expand the competence of the Consumer authority to impose infringement penalties according to the Marketing Control Act § 42, to include the proposed new provision and the Marketing Control Act's provisions on fair marketing practices towards children, in § 21 conf. § 2 of the Markting Control Act.
9. There is a documented prevalence of marketing that children are exposed to for products that are unsuitable for children, that may have impact on their mental and/or physical health. The purpose of the proposal is to limit children's exposure to marketing of products that are unfit for children according to sector-specific legislation, general views of ethics and morality and/or reasons of health and safety, and that may be harmful to children's well-being. The Ministry is of the opinion that the proposal is in line with applicable EEA legislation in the field of marketing and consumer protection. Notably, the Ministry considers that the proposal is in line with the UCPD, as the proposal is not aiming to protect the economic interest of consumers, but aims to protect health and safety and regulate marketing towards children in accordance with taste and decency in the population. The proposal's geographical scope is in line with the current Marketing Control Act and the establishment criterion in the e-commerce act (implementing the e-commerce directive). The Ministry considers that the proposal will constitute a restriction on trade of goods and services, but that the proposed measure fulfils the requirements of non-discrimination, pursues legitimate aims, and is proportionate, as further elaborated in the consultation note chapter 2.5.
