5. Draft Government Regulation on the implementation of certain provisions of the Munition Act

8. This Regulation lays down:
a) minimum requirements for the content, scope and structure of the framework technological procedure prior to the dismantling, deactivation, cutting or destruction of munition;
b) minimum requirements for the content, scope and structure of the framework technological procedure for work during searching for and handling of munition, ammunition and explosives in connection with the provision of pyrotechnical survey;
c) the minimum requirements for the content, scope and structure of the discovery log, the interim pyrotechnical survey report, and the final pyrotechnical survey report;
d) requirements for the safe storage of munition;
e) how the safety of a munition depot is ensured with regards to classification of munition according to their dangerousness and tolerance;
f) special requirements for the safe storage of munition containing inert projectiles or grenades, and requirements for the storage of other inert components of munition;
g) minimum technical and staff requirements for securing munition against misuse, loss, or theft during transport;
h) the model deactivation control mark of a general munition licence holder allowing the identification of munition and the general munition licence holder;
i) the minimum technical requirements necessary to ensure the safety of munition firing ranges, detonation pits for the destruction of munition or a special munition facility, unless they are subject to assessment under the Building Act; and
d) the details of the compulsory content of an operating regulations for a munition firing range, detonation pit for the destruction of munition or special munition facility.

The draft Government Decree refers to the following international legislation:
§ 10 - European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), promulgated under No 64/1987, as amended
§ 15 - Convention concerning International Carriage by Rail (COTIF), promulgated under No 8/1985, as amended
§ 30 of the draft Government Regulation states that the Government Regulation was notified in accordance with Directive (EU) 2015/1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical regulations and of rules on Information Society services.
9. The draft Government Regulation on the implementation of certain provisions of the Munition Act will replace Government Regulation No 217/2017 on requirements for the security of weapons, ammunition, black hunting powder, smokeless powder and primers and on munition depots, Government Regulation No 218/2017 on minimum technical requirements for a munition firing range, a detonation pit for the destruction of munition and special facilities for the detonation, firing or destruction of munition and on mandatory essentials of their operating rules, Government Regulation No 219/2017 on deactivation of certain weapons and ammunition, making cross-sections and destruction of weapons and ammunition and on the minimum content of documentation in relation to disassembly, deactivation, making cross-sections and destruction of ammunition, as amended by Government Regulation No 27/2021, and Decree No 221/2017 on the implementation of certain provisions of the Arms Act, as amended by Decree No 28/2021. The aforementioned implementing legislation, as implementing legislation for Act No 119/2002 on firearms and ammunition (the Arms Act), will expire on 31 December 2025 in connection with the efficacy of Act No 90/2024 on arms and ammunition and Act No 91/2024 on munition.
For this reason, it is necessary to adopt, as one of the new pieces of implementing legislation, a Government Regulation that, within the scope of the empowerment expressed in § 37(4), § 38(6), § 44(2), § 46(2), § 47(3) and § 48(2) of Act No 91/2024 on munition, specifically stipulates:
- minimum requirements for the content, scope and structure of the framework process prior to the dismantling, deactivation, cutting or destruction of munition;
- minimum requirements for the content, scope and structure of the framework work process for searching for and handling munition, ammunition and explosives in connection with the provision of pyrotechnic reconnaissance;
- the minimum requirements for the content, scope and structure of the munition, ammunition and explosives discovery log, the interim pyrotechnic reconnaissance report, and the final pyrotechnic reconnaissance report;
- requirements for the safe storage of munition;
- how the safety of a munition depot is ensured with regards to classification of munition according to their dangerousness and tolerance;
- special requirements for the safe storage of munition containing inert projectiles or grenades, and requirements for the storage of other inert components of munition;
- minimum technical and staff requirements for securing munition against misuse, loss, or theft during transport;
- the model deactivation control mark of a general munition licence holder allowing the identification of munition and the general munition licence holder;
- the minimum technical requirements necessary to ensure the safety of munition firing ranges, detonation pits for the destruction of munition or a special munition facility, unless they are subject to assessment under the Building Act; and
- the details of the compulsory content of an operating log for a munition firing range, detonation pit for the destruction of munition or special munition facility.
