5. Decree of the Ministry of Social Affairs and Health amending the Decree of the Ministry of Social Affairs and Health on the labelling and other appearance of tobacco and related products and their unit packets

6. Tobacco products, electronic cigarettes, refill containers, nicotine-containing liquids, liquids other than nicotine-containing liquids for use in electronic cigarettes

8. The Tobacco Act (549/2016) has been amended by Act xx/2025, which enters into force on pp.kk.202x. A definition of smokeless nicotine product which covers nicotine pouches and products closely resembling these was added to the Act. Nicotine pouches also meet the definition of tobacco substitutes. According to the law, the appearance of smokeless nicotine products and their unit packets shall be harmonised.

Further provisions on the appearance of products and their packaging are issued by decree of the Ministry of Social Affairs and Health in accordance with the Tobacco Act. For this reason, it is proposed that the Decree of the Ministry of Social Affairs and Health on the labelling and other appearance of tobacco and related products and their unit packets (591/2016) be amended so that it would also lay down provisions on the permitted labelling and other presentation of smokeless nicotine products and their unit packets. In addition, it is proposed that sections 22a and 22b of the Decree be amended to take into account smokeless nicotine products and their unit packets. The proposed regulation would largely correspond to the regulation on tobacco products and electronic cigarette products and their unit packets.

The regulation on the harmonisation of smokeless nicotine products and their unit packets will enter into force one year after the entry into force of the Act

9. It is proposed that a new chapter 3c be added to the Decree, providing for the permitted labelling and other appearance of smokeless nicotine products and their unit packets.

It is proposed that a new section 19i be added to the Decree, which would lay down further provisions on the permitted labelling on unit packets of smokeless nicotine products, such as the font type, colour, size, and brand name presentation of the labelling. The regulation would correspond to the current regulation on the permitted labelling of unit packets of tobacco products, electronic cigarettes, and refill containers.

It is proposed that a new section 19j be added to the Decree, which would lay down further provisions on the appearance of the unit packets of smokeless nicotine products, such as shape, colour and material. The proposed regulation regarding the shape and material of the unit packets would largely correspond to the shapes and materials of the dose unit packets of smokeless nicotine products currently on the market. The proposed regulation on the colour of the packaging would correspond to the current regulation on the colour of unit packets of tobacco products, electronic cigarettes and refill containers.

It is proposed that a new section 19k be added to the Decree, which would lay down provisions on the labelling and other appearance of smokeless nicotine products, such as the colour, composition, and shape of a smokeless nicotine product packaged in a dose unit. The proposed regulation would correspond to the appearance of smokeless nicotine products on the market packaged in dose units.

It is proposed that section 22a of the Decree be amended to take into account the proposed new chapter 3c. As a result of the proposed amendment, the labelling referred to in chapters 3a to 3c shall not be in bold font, italicised, underlined or otherwise highlighted. It is proposed that section 22b of the Decree be amended to also provide for the affixing of labelling on the product information of smokeless nicotine products.
