The draft Decree is a measure implementing Act No 110/1997 on foodstuffs and tobacco products and amending certain related acts, as amended, and contains, in particular, a breakdown into types, groups and sub-groups, labelling requirements, quality requirements, technological requirements, and permissible negative weight deviations for packaging with regard to natural sweeteners, foods with sweetening properties, confectionery, cocoa beans, cocoa and chocolate products, and honey. To this end, the Decree contains a total of 17 annexes.

The draft Decree transposes a total of six European Union directives, and this transposition concerns a substantial part of the draft legislation. The Decree transposes the following Directives: - Commission Directive 98/28/EC of 29 April 1998 granting a derogation from certain provisions of Directive 93/43/EEC on the hygiene of foodstuffs as regards the transport by sea of bulk raw sugar. - Directive 2000/36/EC of the European Parliament and of the Council of 23 June 2000 relating to cocoa and chocolate products intended for human consumption, as amended by Regulation (EC) No 1137/2008 of the European Parliament and of the Council and Regulation (EU) No 1021/2013 of the European Parliament and of the Council. - Council Directive 2001/110/EC of 20 December 2001 relating to honey, as amended by Directive 2014/63/EU of the European Parliament and of the Council. - Council Directive 2001/111/EC of 20 December 2001 relating to certain sugars intended for human consumption, as amended by Regulation (EU) No 1021/2013 of the European Parliament and of the Council. - Directive 2014/63/EU of the European Parliament and of the Council of 15 May 2014 amending Council Directive 2001/110/EC relating to honey. - Directive (EU) 2024/1438 of the European Parliament and of the Council of 14 May 2024 amending Council Directives 2001/110/EC relating to honey, 2001/112/EC relating to fruit juices and certain similar products intended for human consumption, 2001/113/EC relating to fruit jams, jellies and marmalades and sweetened chestnut purée intended for human consumption, and 2001/114/EC relating to certain partly or wholly dehydrated preserved milk for human consumption. This Decree repeals: 1. Decree No 76/2003 laying down the requirements for natural sweeteners, honey, confectionery, cocoa powder and cocoa mixtures with sugar, chocolate, and chocolate sweets. 2. Decree No 43/2005 amending Decree No 76/2003 laying down the requirements for natural sweeteners, honey, confectionery, cocoa powder and cocoa mixtures with sugar, chocolate, and chocolate sweets. 3. Decree No 148/2015 amending Decree No 76/2003 laying down the requirements for natural sweeteners, honey, confectionery, cocoa powder and cocoa mixtures with sugar, chocolate, and chocolate sweets, as amended by Decree No 43/2005.
The Decree is proposed to come into effect on 14 June 2026.

The key reason for submitting the new draft Decree is to adapt the requirements for natural sweeteners, foods with sweetening properties, confectionery, cocoa beans, cocoa and chocolate products, and honey to new scientific knowledge, technological developments in the food industry, and directly applicable European Union legislation. The need for this draft legislation stems from the experience gained through the practical application of the existing Decree No 76/2003 laying down the requirements for natural sweeteners, honey, confectionery, cocoa powder and cocoa mixtures with sugar, chocolate, and chocolate sweets, as amended. This Decree will be replaced by the new legislation. At the same time, the requirements of new Directive (EU) 2024/1438 of the European Parliament and of the Council need to be incorporated into the new legislation.
