5. Royal Decree amending the Royal Decree of 31 August 2021 on the production of and trade in foodstuffs composed of or containing plants or plant preparations

Regulation (EC) No 1925/2006 on the addition of vitamins and minerals and of certain other substances to foods: Article 12
The draft provides for restrictions on the use of certain substances (plants) within the meaning of Regulation 1925/2006

Regulation (EU) No 1169/2011 on the provision of food information to consumers: Articles 40, 43, 44 and 45
The draft provides for mandatory labelling particulars for certain plants in order to protect certain sensitive persons or groups.

8. The draft presents an update to the technical progress of the Belgian regulations on plants used in food. The major update concerns mushrooms for which Article 4§1 concerning them has been replaced and its complete list recast (a column specifies whether the mushrooms are wild and/or cultivated). Lists 1 (dangerous plants), 2 (mushrooms) and 3 (plants authorised in food supplements) have been updated.
There is also a linguistic correction to Article 3§2.
A transitional period (2 years) is foreseen in Article 4 of the draft for products that were in line with the previous legislation.

9. This draft decree is intended to ensure improved consumer safety.
The amendment on mushrooms is the result of work carried out by the working group on mushrooms of the advisory committee for plant preparations.
Several entries in Lists 1, 2 and 3 have been amended (indicated in green in the document), following the latest opinions of the advisory committee for plant preparations.
