8. The order sets out the specifications for the EPR scheme for professional packaging. It establishes a primarily financial scheme to cover the costs of separate collection, transport and subsequent treatment of waste, including the treatment necessary to achieve the Union’s waste management objectives, as well as the costs necessary to achieve the other objectives referred to in Article 8a(1)(b) of Directive 2008/98/EC.

These specifications relate, inter alia, to eco-design and provide for the introduction by the producer responsibility organisation of bonuses and penalties on various themes. These bonuses and penalties are discretionary and the amounts are not set out in the specifications, with the exception of the one relating to reusability, for which a minimum bonus amount is defined. This bonus must amount to at least 50 % of the financial contribution for any reusable packaging and 100 % of the financial contribution for any reusable packaging complying with a standard range developed over time by the producer responsibility organisation (2.2 of the specifications).

9. In 2024, only 3.46 % of professional packaging was reported as reused. However, this packaging has a high potential for reuse. A study carried out by Ademe in 2023 on the potential for developing the reuse of packaging estimates, for example, that more than 80 % of wooden and plastic pallets could be re-used, and that between 50 % and 80 % of plastic trays and crates placed on the market could be reused.

Without a bonus applied to reusable packaging for its placing on the market, the amount of the eco-contribution would often be higher for reusable packaging than for single-use packaging (as the costs to be covered are not the same for all materials), even when this cost is spread over several rotations.

In order to promote reuse and to establish a system in line with waste treatment hierarchy, it appears essential to impose on producer responsibility organisations a minimum bonus for reused packaging.

The increased bonus for packaging complying with a standard range developed by the producer responsibility organisation is also intended to encourage the use of such packaging, which allows for flow consolidation and thereby reduces management costs.
