The purpose of the resolution is to establish the obligation for commercial communications of gambling activities to include a message relating to the harmful effects arising from gambling addiction or risky behaviour of the user provided for in Article 10(4) of Royal Decree 958/2020 of 3 November 2020 on commercial communications of gambling activities, which shall replace the message relating to playing with responsibility provided for in Article 10(3) of the Royal Decree, as well as to establish the specifications relating to the form, size, layout, contrast and content of both this message and the message relating to the prohibition of participation of minors provided for in Article 11(4) of Royal Decree 958/2020 of 3 November 2020 on commercial communications of gambling activities.

Royal Decree 958/2020 of 3 November 2020 on commercial communications relating to gambling activities established a new paradigm in advertising in the gambling sector which, among other reasons, responds, as stated in its explanatory memorandum, to social demand for the implementation of preventive, awareness-raising, control and intervention measures in view of the serious consequences that the consumption of certain games of chance and betting can have on certain individuals.
The aforementioned Royal Decree, in Chapter I – Legal regime and general principles of commercial communications – of Title I – Commercial communications of gambling activities, provides, among other general principles that must govern commercial communications: the principle of safe gambling (Article 10) and the principle of the protection of minors (Article 11).
With regard to the principle of safe gaming, Article 10(4) empowers the regulatory authority to establish, by means of a resolution, the obligation for commercial communications from gaming operators to include a message regarding the harmful effects of gambling addiction or risky behaviour on the part of the user, which may be displayed alternatively or cumulatively with the message regarding ‘responsible gaming’ provided for in section 3 of the same provision, opting for the message provided for in section 4 (harm resulting from gambling addiction or risky behaviour) to be the alternative and, therefore, to replace the message provided for in section 10(3). This decision is taken in order to avoid both the excessive number of messages, and the resulting ineffectiveness in achieving the information objective to which they relate, and the proliferation of potentially contradictory messages, all in line with the guidance of the new framework for the protection of consumers of gambling services introduced by Royal Decree 176/2023 of 14 March 2023 on safer gaming environments.
For its part, in relation to the principle of protection of minors, Article 11 of the Royal Decree establishes the obligation that commercial communications from gambling operators must include a warning that minors may not participate in gambling activities.
Both Article 10(5) and Article 11(4) empower the gaming regulatory authority to establish specifications regarding the form, size, layout, contrast and content of both messages.
