In the light of regulatory developments, local authorities or their operators are expressing an increasing need for curative treatment solutions to eliminate contamination by pesticides and PFAS and thus comply with the quality limits laid down by European legislation (Directive (EU) 2020/2184 on the quality of water intended for human consumption) and national legislation (the Order of 11 January 2007, as amended, on the quality limits and reference values for raw water and water intended for human consumption referred to in Articles R. 1321-2, R. 1321-3, R. 1321-7 and R. 1321-38 of the Public Health Code).
Accordingly, on the proposal of representatives of operators of public drinking water services, the Ministry responsible for Health referred the matter to the French Agency for Food, Environmental and Occupational Health & Safety (ANSES) to examine whether it would be appropriate to amend Annex 6 of the Order of 22 June 2012 in order to extend the recognised claims of effectiveness for certain types of membrane filtration (such as nanofiltration (NF) and reverse osmosis (RO)) to micropollutants and organic molecules (including certain pesticides and metabolites and some PFAS).

9. In its opinion issued on 16 May 2025, ANSES recognised the effectiveness of NF and RO membrane-type processes for retaining inorganic and organic micropollutants (including pesticides and PFAS). It is therefore no longer necessary to systematically seek its expert assessment for the use of such treatment systems.

The Order incorporates conclusions issued by ANSES and will henceforth enable companies to place membranes directly on the market without an opinion from ANSES, provided they hold a health compliance certificate, in accordance with Article 4 of the Order. This is thus a simplification measure intended to facilitate access to treatment solutions for organic compounds, including pesticides and PFAS.
