8. The draft amends the previously notified Ordinance (2025:1487) on State aid to improve the continuity of supply in the electricity system (notification number 2025/0734/SE). According to the draft, investment aid in the form of subsidies may also be granted for measures involving investments in the storage of heat, without there being a requirement for the storage facility to be directly connected to a facility for the production of renewable electricity, and investments in high-efficiency cogeneration production that are not powered by biofuel. The draft also introduces provisions whereby lower levels of aid are to be granted to eligible measures that do not meet certain criteria ensuring that the aid specifically promotes resilience and sustainability in accordance with Article 28 of Regulation (EU) 2024/1735 of the European Parliament and of the Council of 13 June 2024 on establishing a framework of measures for strengthening Europe’s net-zero technology manufacturing ecosystem and amending Regulation (EU) 2018/1724.
9. The Draft Ordinance provides that the Swedish Energy Agency may grant state aid to companies for certain measures aimed at improving the continuity of supply in the electricity system.
The conditions for receiving aid are based primarily on the requirements of Commission Regulation (EU) No 651/2014 and Regulation (EU) 2025/1735 (see Sections 4 and 5). In addition, under the existing provisions of the previously notified Ordinance, aid may only be granted for one measure:
1. in an area where the connection of electricity production, or the storage of electricity or heat, contributes to:
a) enabling the connection of new uses of electricity to the electricity grid; or
b) maintaining continuity of supply; and
2. which can be expected to be completed by 31 December 2031 at the latest (see Section 6).
9a. The aid promotes products that meet certain technical requirements. The technical requirements are set out in Sections 5 and 5a of the Draft Ordinance amending the previously notified Ordinance. The draft involves amending the current Section 5 and introducing a new section, Section 5a. Relevant technical requirements are also set out in Sections 6 and 9 of the current Ordinance.
Under the draft amended Ordinance, aid may, if funds are available, be granted as investment aid in accordance with the conditions laid down in Chapter I and Articles 41 and 46 of Commission Regulation (EU) No 651/2014 (see Section 4).
In addition to the wording of the current Ordinance, it is proposed that the aid be provided in the form of a subsidy for measures involving investments in the storage of heat – without being required that the storage facility is directly connected to a facility for the production of renewable electricity – and investments in high-efficiency cogeneration production that are not powered by biofuel (see Section 5).
For products falling within the scope of Article 28 of Regulation (EU) 2024/1735, the Swedish Energy Agency shall determine and publish, for each application period, criteria ensuring that the aid promotes, in particular, resilience and sustainability in accordance with that Regulation. Eligible measures that do not meet such criteria shall receive a lower level of aid than measures that do meet the criteria (see Section 5a).
9b. The draft amends the previously notified Ordinance (2025:1487) on State aid to improve the continuity of supply in the electricity system (notification number 2025/0734/SE). 9c. One of the aims of the requirements in Section 6 is that the measure should contribute to improving resource adequacy in the electricity system and increasing the capacity of the electricity system regionally and where the needs are greatest. In addition, under the current provisions, aid may not be granted to a plant for the production of electricity or heat from round timber of industrial quality, stumps or roots (see Section 9). The requirement is based on Article 3(3)(c) of Directive (EU) 2018/2001 of the European Parliament and of the Council of 11 December 2018 on the promotion of the use of energy from renewable sources (the Renewable Energy Directive), as amended by Directive (EU) 2023/2413 of the European Parliament and of the Council. The roundwood used for energy production in Sweden is typically damaged or has such characteristics that it does not meet the definition of roundwood of industrial quality. Stumps and roots are used to a limited extent. The requirement should therefore not pose a problem or entail any additional costs for the vast majority of facilities. Against this background, all the requirements for receiving aid under the Ordinance are deemed to be proportionate.
