5. Act Amending the Act on Products and Market Surveillance, the Act on Precious Metals and Conflict Minerals and the Act on Accessibility Requirements for Products and Services.
6. The Precious Metals and Conflict Minerals Act already covers any product made wholly or partly of precious metals or their alloys (gold, silver, platinum and palladium).

8. This is an omnibus Act that amends various acts. This notification relates solely to Section 2 concerning the amendment to the Act on Precious Metals and Conflict Minerals (hereinafter referred to as the 'Precious Metals Act').
9. The legislative proposal proposes, inter alia, an amendment to the scope of the Precious Metals Act, according to which goods offered for sale as containing precious metals will also be covered by the Act. Several provisions are adapted accordingly and the level of sanctions is relaxed.
Under the terms of the legislative proposal, the Danish Business Authority will be able to carry out inspections in this area in relation to the goods covered, which will in future include both articles made of precious metals and articles offered for sale as containing precious metals. It will be possible to impose sanctions on legal and natural persons who market goods as being made of gold, silver, platinum and palladium, when this is not the case.
Thus, the proposed amendments to the Act do not contain any substantive barriers to trade.
9a. The purpose of the proposed amendments is, inter alia, to broaden the scope of the law in order to ensure that goods are not offered for sale in a misleading manner. The same product requirements (purity requirements) will continue to apply to precious metals under the Act. Under current legislation, a business may be penalised if a correctly hallmarked item is offered for sale as a ‘silver ring’ but contains only 700 parts per thousand of silver. In that case, the product does not meet the minimum standard of fineness for silver of 800 parts per thousand and the person offering the product will be ordered to withdraw it from the market. If, on the other hand, the ring turns out not to contain silver at all, it will be an article that does not meet the definition of precious metal articles in the Act and will therefore not be covered by the Act. In the light of the above, it is considered that the measure is appropriate to ensure that goods offered for sale as containing precious metals actually contain precious metals, as the goods will be verifiable.
9b. The proposed amendments are considered necessary to ensure fair competition between businesses and to strengthen consumer confidence in goods offered for sale as containing precious metals.
9c. It is estimated that the proposed amendments are likely to impose only a very limited burden on the business community in the form of administrative consequences, which have not been quantified in any further detail.
