5. Regulation of the Minister for Finance and Economy on the technical conditions to be met by buildings and their location, and on the technical conditions for the use of residential buildings
6. Technical conditions for buildings and associated building equipment and their location on a building plot, as well as technical conditions for the use of residential buildings

8. The Regulation lays down technical conditions to be met by buildings and associated building equipment and their location on a building plot, as well as technical conditions for the use of residential buildings, including:
1) requirements for the development and layout of the building plot (the location of buildings, pedestrian access routes and access roads, parking spaces and garages for cars)
2) requirements to be met by buildings and rooms (lighting and sunlight exposure, entrances to buildings and residential premises, residential premises adapted for people with disabilities)
3) requirements to be met by the technical equipment of buildings
4) requirements to be met by a building in terms of structural safety
5) requirements to be met by a building in terms of fire safety (fire resistance of buildings, fire compartments and fire separations, escape routes, conditions for installing photovoltaic devices, energy storage facilities)
6) requirements to be met by a building in terms of safety in use
7) requirements to be met by a building in terms of hygiene and health of users (protection including air cleanliness, protection against ionising radiation and electromagnetic fields)
8) requirements to be met by a building in terms of protection against noise and vibrations
9) requirements to be met by a building in terms of energy saving and thermal insulation
10) requirements for the use of solar radiation energy
11) requirements for the use of residential buildings
9. The provisions of the draft regulation, in particular:
1) eliminate barriers to the implementation of defence infrastructure,
2) implement EU law (Directive (EU) 2023/2413, Directive (EU) 2023/2413, Regulation (EU) 2024/1309),
3) introduce solutions concerning accessibility for people with special needs, including people with disabilities,
4) introduce solutions for a significant improvement in the fire protection of buildings in connection with fires that have occurred in the country,
5) introduce technical conditions for the use of residential buildings (hitherto, the provisions concerning the use of residential buildings were set out in another piece of legislation).
9a. The draft introduces requirements appropriate to the objective pursued – an adequate level of safety.
9b. The statutory authorisation requires a new regulation to be made by 20 September 2026.
9c. No disproportionate burden has been identified in relation to the objective pursued.

12. It is requested that the urgent procedure be applied and that the notification procedure be expedited, given the need to facilitate without delay the implementation of investment projects carried out in restricted areas designated by a decision of the Minister of National Defence. These projects are of significant importance for ensuring the defence capabilities and security of the Republic of Poland, particularly in the current geopolitical context, where the efficient implementation of strategic investments is of key importance.
The solutions contained in the regulation adapt the requirements to the specific nature of military facilities and reduce the need to apply for exemptions from technical and building regulations, thereby accelerating the procedure for obtaining a building permit and, consequently, the implementation of the investment.
In view of the exceptional situation at the border between the Republic of Poland and Ukraine, and recent events relating to the violation of Polish airspace, there are grounds indicating serious and unforeseen circumstances relating to the protection of public health or safety, which justify the use of the urgent procedure and the adoption of the provisions as swiftly as possible.
Furthermore, the draft regulation contains a number of provisions affecting the safety of humans and animals, including fire safety, protection against radon ingress into buildings, increased accessibility for people with disabilities, and climate change adaptation.
