5. Amendment to a decree concerning lead paint risk assessments in residential buildings, carried out in accordance with the requirements of the Public Health Code

8. To prevent lead exposure in children and pregnant women, the Public Health Code mandates a lead exposure risk assessment [constat de risque d'exposition au plomb] (CREP) for all or part of a residential building constructed before 1 January 1949.
The procedures for carrying out this CREP, which are the responsibility of certified professionals, are described in the decree of 19 August 2011, concerning the lead exposure risk assessment (CREP). The lead exposure risk assessment involves measuring the lead concentration in the building's paint coatings to identify those containing lead, describing their condition, and identifying, where applicable, situations that pose a risk of lead poisoning in children or deterioration of the building.
The decree mandates that these assessments be carried out using a portable X-ray fluorescence equipment capable of analysing at least the K line of the fluorescence spectrum emitted by the lead.
The amendment to this decree now aims only to define performance criteria for lead detection in the equipment used to perform these assessments, rather than specifying equipment categories.
9. Currently, only lead paint analysis equipment that is capable of detecting the lead K line can be used to perform lead exposure risk assessments (CREP) under the Public Health Code. This clarified the technological criterion for selecting equipment that was capable of detecting lead located deep within the coatings. In practice, this means only using equipment with a radioactive source.
As a result of technological advancements, the performance of the two existing types of equipment (X-ray tube equipment and equipment with a radioactive source) has become equivalent. Based on this, the French Agency for Food, Environmental and Occupational Health & Safety [Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail] (ANSES) recommended replacing the technological criterion for selecting equipment to perform regulatory lead detection with performance criteria for lead detection (opinion of July 2025). This will allow the use of other types of equipment and will help reduce the number of radioactive sources in circulation.
Consequently, the decree is amended as follows:
- Removal of the technological criterion for equipment (capacity to detect the lead K line) and replacement with a requirement to meet performance criteria;
- Addition of the performance criteria proposed by the National Testing Laboratory and the Scientific and Technical Centre for Building [Centre scientifique et technique du bâtiment] (CSTB) for evaluating equipment: accuracy, repeatability, and reproducibility of measurements around the management threshold mentioned in the decrees (1 mg/cm²).
