amending the Vehicles Order in connection with expiry of the option to designate special mopeds in the Road Traffic Act 1994 and the approval of special mopeds by the Road Traffic Service and updating of the permanent requirements on special mopeds

This Order pertains to the transformation of the special moped designation process by the Minister for Infrastructure and Water Management into a special moped approval by the Road Traffic Service [RDW] as the approval authority. In addition, this amending Order updates the permanent requirements applicable to special mopeds.

This Order further implements the transformation of the special moped designation process (moped-like vehicles that do not fall under European vehicle regulations, in particular Regulation (EU) No 168/2013) by the Minister for Infrastructure and Water Management into a national type-approval by the Road Traffic Service [RDW] as the approval authority. In doing so, this amending Order updates the permanent requirements applicable to special mopeds.

Article I(J) of the draft Order may contain technical regulations, in the form of an amendment to the Vehicles Order [Regeling voertuigen]. Special mopeds are subject to requirements when used on roadways. This includes requirements on the general vehicle construction method, dimensions, mass, engine system, fuel system, suspension, steering system, brake system, bodywork, lights, light signals and retroreflective devices.

An explicit mutual recognition clause is not provided because the rules apply regardless of vehicle origin.

9. The requirements are necessary to ensure road safety. In some cases, the requirements link up with European and other requirements applicable to vehicle approval/authorisation, in particular Regulation (EU) No 168/2013. Setting requirements on the structure of special mopeds for the use phase provides the best and most direct assurance of road safety. Enforcement is possible when road safety is under threat. The requirements are also non-discriminatory because they apply regardless of the origin of the vehicle or driver. The requirements are proportionate because they only prescribe what is necessary to safeguard road safety.
