8. No maximum permissible content can be determined for tetrodotoxin (TTX) in live bivalve molluscs. Any presence of TTX in live bivalve molluscs can pose a risk to public health. This policy guideline indicates which measures the Dutch Food and Consumer Product Safety Authority (NVWA) takes with regard to the presence of TTX in live bivalve molluscs starting from 20 μg/kg (the detection limit). This competence is based on Regulation (EC) Nos 854/2004 and 178/2002.
The sanitary shellfish survey (SSS) monitors the presence of E.coli, potential toxic phytoplankton and biotoxins in all Dutch production areas. In the meantime, TTX has been added thereto. The frequency and the number of samples in the production areas are stipulated in the SSS. These frequencies are determined in the Policy Guideline on sampling plans for sanitary surveys.
This policy guideline for TTX in live bivalve molluscs provides for the following:
1. It supplements the Policy Guideline on sampling plans for sanitary surveys with measures with regard to the presence of TTX.
2. The NVWA acts against live bivalve molluscs made available on the market with a TTX content that is greater than or equal to 20 μg/kg.

9. TTX is a dangerous toxin that even in low concentrations can lead to fatal paralysis in humans. In 2015, the RIKILT Institute for Food Safety carried out a survey into TTX in live bivalve molluscs from Dutch production areas. It revealed that TTX can be found in mussels and oysters from Dutch production areas.
No permissible maximum content of TTX in bivalve molluscs can be determined. Any presence of TTX in bivalve molluscs can pose a threat. In this policy guideline, the TTX content that can be reliably and reproducibly determined with the applied analysis method is taken as the limit, i.e. greater than or equal to 20 μg/kg (the detection limit).
Measures are taken to protect public health. It is not possible to adopt a less far-reaching measure, since TTX (even in low concentrations) can lead to fatal paralysis in humans. Given the major consequences for human health, the measures are proportional.
