The notified draft defines the architectural and material obligations, but also the organisational, informational and procedural obligations, for gambling operators with regard to the security policy of information systems. Compliance with these obligations should enable the National Gambling Authority, which supervises their activity, to assess the technical and human resources used to manage the risks associated with technical and functional systems for the collection, management and retention of data.

These obligations must be complied with by operators from the beginning of their activity. Their compliance must also be anticipated by online gambling operators before they apply for authorisation or renewal.

The provision of a gambling offer by an operator presupposes compliance by the operator with technical requirements relating both to the characteristics of the platforms and software he operates and to the integrity and security of his information systems. Compliance with such requirements is necessary for operators to be able to offer, and players to accept, gambling offers in a secure setting. These requirements serve as much to protect the operator and the player, in that they aim in particular to prevent manoeuvres by third parties who may wish to fraudulently enter the information system of the former.

Article 34 VIII of Act No 2010-476 of 12 May 2010 gives the Authority the power to determine these technical requirements. Thus, inter alia, the draft determines, in particular, from a technical point of view, the documents and information that the file must contain to request an application for authorisation, in line with the provisions of the Order of 27 March 2015 approving the specifications applicable to online gambling operators. It also contains, on the same subject, rules concerning operators with exclusive rights.
